Is distributing your own-made levels legal?

Post by jw »

Ever considered that distributing your own made levels could be illegal?
I never did untill I downloaded some levels and the zip-file contained also this read-me-file.

Dear Mr.Ilja,

I don't have a readme file about this subject, but now I tell you that you
may distribute and upload to internet levels that you have created in the
editor. Is this enough for you instead of a readme file? I'm very happy you
like the game, thanks.

How could it be illegal? Balazs himself says there that you can do that.

the readme file says that it is illegal to change the game. the patches elma 1.1hb, elma 1.2, and nitro are illegal. your own levels are your own files, and it is illegal for other ppl to change them without your permission. it's about the same thing as if you make a drawing with photoshop, you have the copyright, adobe doesnt.

I know, but before I read it, I didn't know he had said/ written that.

That's not completely the same, because a drawing is some stand-alone-thingy. U can use it without Photoshop. An ElMa-level can alone be used in ElMa. If you want to sell your level you could theoretically make money with someone else his game.
Most other games I know only give permission to non-commercial distributing of levels. But where is the border? Asking money for them/ selling them is illegal then, unless your countries laws overrule those user agreements. But freely distributing it true a profit making sponsored website, would that be legal?

I would guess the source code of Elasto Mania.
Was it cast for the mass who burn and toil?
Or for the vultures who thirst for blood and oil?

Well, you don't change the level inside the game so I would guess not. But the levels that they have made are copyrighted to them, so you wouldn't be allowed really to spread an edited file of those levs.
